Understanding prescription refill limitations

Here at Gatlin Voelker, PLLC, we have helped many in Fort Mitchell deal with charges stemming from alleged prescription drug abuse. If you are like many of them, then any misconduct you are accused of may be due to trying to refill a prescription. The conditions that may require you to take medication may end up lasting longer than your initial dosage of medication, prompting you to seek more. Often, arguing against a charge of drug abuse may simply be a matter of your not knowing when you are required to get a new prescription from your doctor.

The state of Kentucky has a schedule of drugs used to classify both legal and illegal substances. According to the Kentucky Cabinet for Health and Family Substances, these are broken down into four classes, known distinctively as Schedule II, III, IV or V controlled substances. Some of the more common medications that doctors prescribe are classified as follows:

  •          Hydrocodone (Vicodin): Schedule II
  •          Phenobarbital (Luminal): Schedule III
  •          Alprazolam (Xanax): Schedule IV
  •          Codeine prescriptions (Tylenol w/ Codeine Elixir: Schedule V

The website for the Kentucky Legislature shows that a written, oral, electronic or facsimile prescription is required in order for you to have medications given or refilled by a pharmacist. For all Schedule III, IV and V substances, you cannot have a prescription refilled more than five times without needing to have it renewed by your doctor. In some cases, a simple phone call from your provider may be enough to prove your need for a refill. All Schedule II substances, however, can never be refilled. You must first obtain a new prescription before receiving a second dosage.
